VAN WERT – The following individuals were seen in the Van Wert Court of Common Pleas by Judge Martin Burchfield:

Thursday, Aug. 30, 2018

SENTENCINGS

Dezmond Bywaters, 26, Van Wert was sentenced on 10 charges. He was sentenced on five counts of importuning, F5, one count of disseminating matter harmful to juvenile, F5 and four counts of illegal use of minor in a nudity oriented performance, F5. Some counts were sentenced concurrently to each other and some consecutive for an aggregate of 36 months prison with credit for 20 days served. He was also ordered to pay court costs and he was classified as a Tier 1 sex offender.

Melissa Nihiser, 32, Van Wert, was sentenced for aggravated possession of drugs, F5. She was sentenced to three years community control, up to 6 months at WORTH Center, 200 hours community service, drug court evaluation, and ordered to serve 30 days jail at a later date. She was also sentenced to 180 days jail for violating her previous probation with credit for 40 days served. That jail sentence will run concurrently with the new sentence. She was also ordered to have a substance abuse assessment and treatment, two years of intensive probation, and ordered to pay partial appointed counsel fees, costs, and a monthly probation fee.

Donald O’Day, 41, Van Wert, was sentenced for aggravated possession of drugs, F3. He was sentenced to 30 months prison with credit for 101 days served and ordered to pay court costs.

Bryan Lynch, 26, Paulding, was sentenced for aggravated possession of drugs, F5. He was ordered to three years community control, 30 days jail at a later date, 200 hours community service, two years intensive probation, and ordered to pay partial appointed counsel fees, monthly probation fee, and costs.

Dustin Akers, 40, Lima, was sentenced for failure to provide notice of change of address as a sex offender, F4. He was sentenced to 12 months prison with credit for four days served, and also ordered to pay court costs.

PLEA

Christopher Wicker, 35, Fort Wayne, entered a guilty plea to a prosecutor’s bill of information charging him with falsification, M1. The Court set sentencing for Sept. 24, 2018, at 9 a.m.

Wednesday, Sept. 5, 2018

ARRAIGNMENT

Gerald Shreve, 24, Hicksville, entered a not guilty plea to trespass in a habitation, F4. He was released on surety bond with a pretrial set for Sept. 26, 2018, at 8 a.m.

VIOLATIONS

Dustin Stuckey, 32, Middle Point, admitted to violating his bond by failing to report to probation. Bond set at $500 cash or commercial surety and pretrial set for Oct. 10, 2018, at 8 a.m.

Idris Nuriddean, 43, Van Wert, admitted to violating his probation by failing to report to jail as ordered. He was sentenced to an additional 10 days added to his previous sentence.

Lester Sulfridge, Jr., admitted to violating his bond and his treatment in lieu program by consuming alcohol. Sentencing set for Oct. 10, 2018, at 9 a.m., and he was released on surety bond.

CHANGES OF PLEAS

Tyran Jemison, 45, Van Wert, entered a guilty plea to a prosecutor’s bill of information charging him with aggravated trespass, M1. Defendant was then sentenced to three years community control, ordered to have no contact with victims, 120 days jail, credit for 61 days served, 59 days suspended.

Frederick Murray, 32, Delphos, changed his plea to guilty to theft, F5. The Court ordered a pre-sentence investigation and set sentencing for Oct. 10, 2018, at 9 a.m.
