VAN WERT – The following cases were seen in the Van Wert Court of Common Pleas by Judge Martin Burchfield:

FRIDAY, NOVEMBER 22, 2019

ARRAIGNMENTS

Faith Sevitz, 39, Van Wert, entered a not guilty plea to aggravated possession of drugs, F5, possession of heroin, F5, and possession of a fentanyl-related compound, F5. She was released on a surety bond with pretrial set for Dec. 11 at 10 a.m.

Nathan Dunn, 37, Van Wert, entered a not guilty plea to aggravated possession of drugs, F3, possession of a fentanyl-related compound, F5, complicity in trafficking, F3, permitting drug abuse, F5, and aggravated possession of drugs, F5. He was released on a surety bond with a pretrial set for Dec. 11 at 10 a.m.

BOND VIOLATION

Colby Black, 35, Ohio City, admitted to violating his bond by failing to report to jail as ordered to serve his sentence. He was ordered to jail to serve his 120 days sentence with credit for 30 days already served.

TUESDAY, NOVEMBER 26, 2019

CHANGE OF PLEA

Caleb Geise, 27, Delphos, changed his plea to guilty to trespass in a habitation, F4. Related charges were dismissed for his plea. He then requested and was granted intervention in lieu of conviction and his case was stayed pending completion of the treatment program.

WEDNESDAY, NOVEMBER 27, 2019

CHANGES OF PLEA

Charles Jenkins, 42, Van Wert, changed his plea to guilty to aggravated trafficking drugs, F3 and possession of heroin, F5. The Court ordered a pre-sentence investigation and set sentencing for Jan. 22, 2020, at 9 a.m.

Amanda LaBounty, 36, Payne, changed her plea to guilty to two counts of falsification, M1. The Court set sentencing for Dec. 18 at 9 a.m. 

Candelario Jimmie Benavidez, 67, Van Wert, changed his plea to guilty to illegal use of minor in nudity-oriented performance, F5. The Court ordered a pre-sentence investigation and set sentencing for Jan. 22, 2020, at 9 a.m.

SENTENCINGS

Chad Harter, 41, Willshire, was sentenced for felonious assault F2. He was sentenced to three to four and a half years in prison, with credit for 194 days served. He was also ordered to pay court costs.

Dillon Nihiser, 23, Van Wert, was sentenced for aggravated possession of drugs, F5, and theft F5. He was sentenced to 180 days on each charge, to run consecutive, with credit for 58 days served.

Calvin Placke, 25, Convoy, was sentenced for trafficking marijuana, F5, and possession of hashish, F5. He was sentenced to three years community control, 30 days jail beginning Jan. 4, work release, substance abuse assessment and treatment, additional 30 days jail at a later date, 200 hours community service, and two years of intensive probation. He had to forfeit $1,993 used in the crime, and was ordered to pay partial appointed counsel fees, costs, and monthly probation fee.

Ashley Carr, 19, Van Wert, was sentenced for aggravated trafficking drugs, F2. She was sentenced to three to four and a half years prison, with credit for 199 days served. She was also sentenced for possession of fentanyl-related compound, F5. She was sentenced to 12 months in prison with credit for 24 days served. The sentences are to run concurrently. She was ordered to pay court costs.

Jay Yoh, 60, Van Wert, improper handling firearm in a motor vehicle, F4, and OVI, M1. He was sentenced to three years of community control, 10 days jail beginning Dec. 3, and substance abuse and assessment. His license will be suspended for one year from Aug. 1, 2019, and his 9 mm pistol was forfeited to the Van Wert Police Department. He was also ordered to pay a fine of $525, monthly probation fee, partial appointed counsel fees, and court costs.

ARRAIGNMENT

Justin Reiley, 37, Van Wert, entered a not guilty plea to aggravated possession of drugs, F5, possession of heroin, F5, and possession of fentanyl-related compound, F5. He was released on a surety bond with a pretrial set for Dec. 17 at 11 a.m.
